Delhi Court Refuses to Cancel LOC Against ATS Infrastructure Promoter

Judicial Magistrate Yashdeep Chahal, in his September 13 ruling, stated that while the accused have cooperated with investigations and appeared when required, the LOC serves as a precautionary measure to ensure that the judicial process is not obstructed.

 

NEW DELHI: A Delhi court has declined to cancel the lookout circular (LOC) issued against ATS Infrastructure Limited’s promoter, Geetamber Anand, and his wife, Poonam Anand. The couple faces multiple FIRs, including those filed by the Economic Offence Wing (EOW) of the Delhi Police for allegedly defrauding homebuyers, as well as a money laundering case initiated by the Enforcement Directorate.

Judicial Magistrate Yashdeep Chahal, in his September 13 ruling, stated that while the accused have cooperated with investigations and appeared when required, the LOC serves as a precautionary measure to ensure that the judicial process is not obstructed.

The judge highlighted that even if the accused were instructed to seek court permission before traveling abroad, they could still choose to travel without it, and the court would have no way to enforce such a condition. He further explained that while personal liberty is important, reasonable restrictions may be imposed in accordance with the law.

"In light of the above discussion, I do not see sufficient reasons to direct the recall or cancellation of the LOC," the judge concluded.

However, he did note that it is essential for authorities to provide the accused with reasons for preventing their travel, as it is their basic right to be informed.
