ED Raids on Amazon and Flipkart Vendors: Investigations into Alleged FDI Violations, Unfair Trade Practices

Enforcement Directorate (ED) on Thursday carried out searches at 19 locations linked to vendors supplying to Amazon and Flipkart. ED conducted searches under FEMA at locations in Delhi, Bengaluru, Mumbai, Hyderabad, and Panchkula. According to the officials, it was based on a complaint against such e-commerce platforms for allegedly violating India's foreign direct investment policy as they were said to be influencing the product's selling prices by disrupting fair competition, thereby affecting the smaller vendors.
Complaints and Regulatory Concerns
The ED has launched its raids based on multiple complaints against Amazon and Flipkart for indirectly controlling the product pricing on their respective sites. This indirect control under the pretext of exercising free will over the products breaks FDI norms and thus does not provide a level-playing field for independent vendors either. Eight vendors under probe, officials said, so far have not been identified, though "certain documents" seized during raids are now being analyzed for further proof of the alleged FDI Violations.
ED teams coordinated across cities for these raids early on Thursday morning, examining crucial documents at premises linked with the vendors," said an official. Both Amazon and Flipkart were approached for comments; Amazon refused to comment on the issue while Flipkart did not put out a statement on it.
Business Houses Welcome ED Action
The Confederation of All India Traders, one of the powerful trade bodies, has emerged in support of the action of the ED. CAIT has been one of the loudest critics of the big e-commerce platforms that adopted harmful practices against the small-time traders and the traditional retail shops. The Secretary General of CAIT and BJP MP from Delhi, Praveen Khandelwal, said, "For years we have been raising the issue regarding unfair trade practices, and we welcome the ED's actions.".
Earlier, CAIT and the All India Mobile Retailers' Association had moved petitions in the Competition Commission of India (CCI) seeking a curb on the operations of these platforms, alleging that they were resorting to predatory pricing.
The CCI has imposed penalties on Amazon, Flipkart, and several their associates for anti-competitive practices.
Predatory Pricing Concerns
The issues involved with these allegations of predatory pricing which Amazon and Flipkart have been indulging in providing deep discounts on their portals, according to the opponents, by significant cash reserves are thus driving out small retailers. The probe currently undertaken by the ED with the support of CAIT may result in a stricter regulation for e-commerce companies and a review of the FDI policies governing their function.
