Shimla Mosque Cuts Down on Controversy: Illegal Floors Get the Ax!

The municipal commissioner had initially granted a two-month period for the removal of the unauthorized construction, and the committee has now taken the first steps toward compliance.
 

SHIMLA – The long-standing controversy surrounding the Sanjauli Mosque in Shimla, Himachal Pradesh, is approaching resolution as the mosque committee has begun demolishing the illegal portions of the structure. The move follows the receipt of a No Objection Certificate (NOC) from the Wakf Board, which oversees the property. The municipal commissioner had initially granted a two-month period for the removal of the unauthorized construction, and the committee has now taken the first steps toward compliance.

The illegal construction, which included three additional floors, is being dismantled by the mosque committee at its own expense. The process commenced with the removal of the roof, and the committee is in talks with both the Wakf Board and the courts regarding further actions and potential financial aid.

Committee President Speaks Out

Mohammad Latif Negi, the president of the Sanjauli Mosque Committee, confirmed that the demolition work began after laborers arrived. He noted that while the Wakf Board granted permission to proceed with the demolition, they have clarified that they will not provide financial support. "We will continue to negotiate with the board and consult with the courts on this matter," Negi said.

Legal Process and Government’s Response

Himachal Pradesh's Urban Development Minister, Vikramaditya Singh, commented on the situation, emphasizing that the mosque's illegal portion is being removed following proper legal procedures. Singh expressed hope that this step will maintain peace in the state, known for its harmonious environment. He encouraged the mosque committee to seek assistance from the courts if they face financial difficulties during the demolition.

The demolition follows an order issued by the municipal commissioner on October 5, mandating the removal of the mosque's three unauthorized floors. The mosque committee was given a two-month deadline to complete the demolition.

Seeking Wakf Board’s Approval

In response to the municipal order, the mosque committee reached out to the Wakf Board, requesting legal guidance and approval for the demolition. Since the property is under the ownership of the Wakf Board, the committee stressed that any construction or demolition activities would only proceed in accordance with the board's directives. With the board’s approval now in place, the demolition process has moved forward.

Appeal Planned by Muslim Organization

Meanwhile, the All Himachal Muslim Organization had previously announced its intention to challenge the municipal commissioner’s decision in an appellate court. The organization argued that the order was based on unauthorized applications and failed to consider the mosque’s historical significance and ownership details.

The Sanjauli Mosque dispute, which has been a source of tension in the region, is nearing a conclusion as the illegal construction is being dismantled. The mosque committee's cooperation with local authorities and the Wakf Board signifies a step toward maintaining peace in Shimla. While challenges remain, including potential legal appeals, the ongoing demolition reflects efforts to resolve the matter within the bounds of the law.
