In a significant ruling, the Punjab and Haryana High Court upheld a divorce decree for a husband who claimed his wife’s actions, including calling him "impotent" and insulting his health, constituted mental cruelty. The court found these behaviors, as documented by the family court, sufficient for divorce, despite the wife's denial and counterclaims. The husband also alleged that she mistreated his ailing mother and expressed a desire to marry someone else, solidifying the court’s decision to uphold the initial divorce judgment.
Divorce News Case, Court Upholds Divorce Over Mental Cruelty Claims
In a family courts judgment upheld recently by the Punjab and Haryana High Court, a decree for divorce has been granted in favor of a husband who said his wifes acts, which included calling him "impotent" and telling his mother that she "brought into the world a eunuch," had amounted to mental cruelty. The bench, comprising Justices Sudhir Singh and Jasjit Singh Bedi, while making this observation noted that these remarks and behaviours, as reflected in findings of the family court, were sufficient to cause grave emotional distress. Six years into their separation, the relationship had remained beyond redemption.
Wife's addiction to porn triggered cruelty by husband; start divorce
During the divorce case, the husband accused his wife of being addicted to pornography and often insulted him about his health. He also said she asked his old mother with arthritis to climb stairs several times a day to fulfill her needs. The husband claimed that the atmosphere hostile around his wife made further claims that even she wanted to marry another man. She denied these allegations and contended that the family court had ignored the alleged cruelty inflicted upon her by her husband's family. Nevertheless, it dismissed the claims raised by her as being unrebutted, reiterating that the initial allegations of the husband were soundly established by imputing mental cruelty on the part of the wife and divorce granted by the family court should not be interfered with.
