Old Petrol,Diesel Cars Not to Get Re- registered Even After Passing Emissions : Delhi High Court

Published Date:

Vehicle emissions has been an element that the government wants to curb as much as possible, but just like other sectors where a revolution seems to follow up earlier than an domestic evolution to help  has been the case in automotive sector as well. Even before settling a grand base for vehicle scrapping the Court has taken a ardent and rigid decision not to renew vehicles older than 15 years of age if petrol or 10 years of age if Diesel even if they pass Emissions test.

Owners allowed to Sell their cars to other states

Although the owners will be allowed to sell their vehicles in neighboring states after an NOC issued by the concerned RTO, this is one of the most confusing decisions if we have ever seen one. If the vehicles are being denied new registration because they are a major element in polluting the environment why are they allowed to be sold to neighboring states, of what good would they be there. And if they are allowed to run freely in the other states of what good the decision of not re registering them has been , off they go polluting still.

There remain to be major Ambiguity in the official decision passé by the court. the impetus of the whole movement was a plea filed by a 72 year old men out of Nizamuddin who wanted to renew the registration of his 16 year old Honda City petrol with only about 20,000 kms on the odometer. The car was kept in a speck less manner sound mechanically , passing the pollution tests. but because of the blanket ban on old cars getting re registered the man was denied re-registration.

Increased Charges and penalties-(Old Petrol,Diesel Cars Not to Get Re- registered : High Court judgement )

A new rule has been passed recently by the Ministry of Road Transport and Highways. Which stipulates that hefty amounts can be charged for re-registering and high penalties for vehicles that are older than 15 years. This new rule is part of amendment in the Central Motor Vehicles Rules, 1989, which came into effect on April 1, 2022.

re-registration of old cars beyond15 years would also affect Big car manufacturers, as due to these the sales of new cars would also dive down . As seen in America this would result in whole fleets of cars being used for more than 15 years after passing rigorous emissions tests. And manufacturers really bringing in new ingenious products to bring in new customers. Unlike providing cheap tech in name of ingenuity from china.
