Reason Behind the Police Action

According to the Gurugram Police, a formal notice was sent to WhatsApp via email on July 17 as part of an investigation into a sensitive matter. The police had requested details about specific mobile numbers related to the case. However, WhatsApp not only declined to provide the information but also raised objections that the police deemed "unlawful."

Despite repeated follow-ups, including a second notice sent on July 25, WhatsApp failed to respond by the deadline of August 28. The lack of cooperation led the police to take legal action against the platform.

Allegations of Unprofessional Conduct

Gurugram Police have accused WhatsApp of exhibiting unprofessional behavior by withholding the requested information. Authorities have raised concerns that the platform’s refusal to comply may have provided indirect assistance to the accused in the case.

"Repeated requests were ignored, and WhatsApp's reluctance to share crucial data is helping the accused evade justice," a police spokesperson said.

Legal Action Taken

On Saturday, a case was officially registered at the Cyber Crime East Police Station in Gurugram. The charges against WhatsApp directors and nodal officers fall under sections 223(A), 241, 249(C) of the BNS, and the Information Technology Act.

The Gurugram Police have stated that under current Indian laws, WhatsApp is legally obligated to provide the requested data. By refusing to comply with the investigation, the messaging platform has knowingly violated these laws, prompting the legal action.

WhatsApp's Role in Investigations

WhatsApp, like other tech companies, is frequently requested by law enforcement agencies to share data in criminal investigations. Under the Information Technology Act, platforms operating in India are expected to comply with legal orders.
