Gyanvapi dispute: SC orders transfer of proceedings to dictrict judge for trial

The Supreme Court has ordered the transfer of the proceedings to the Varanasi district judge for trial. It was pending before the Varanasi civil judge (senior division) in connection with the Gyanvapi dispute.

A bench presided by Justice DY Chandrachud said, “Having regard to the complexity of the issues involved in the suit and the sensitivity, we are of the view that the suit before civil judge (senior division) Varanasi should be tried before a senior and experienced judicial officer of the UP higher judicial service. We accordingly order and direct that the suit shall stand transferred from civil judge (senior division), Varanasi, to the court of the district judge, Varanasi, for trial…”

It says that the application filed by the Gyanvapi mosque committee challenging the maintainability of the suit would be decided on priority by the district judge.

The court has asked the DM to ensure that appropriate arrangements are made for wazu (ablution) at the mosque.

The Muslim side argues that the Varanasi court order was in violation of the Places of Worship Act, 1991.
