Bhopal: A video of BJP leader Manoharlal Dhakad went viral on the Mumbai-Delhi Expressway in Mandsaur district. After which, the police arrested the leader. The viral video is said to be of May 13. The incident was captured in high-security CCTV cameras installed on the highway. After the arrest of the BJP leader, it is now believed that strict action can be taken against him. How serious is the crime of doing obscene acts openly on the highway? What is the provision of punishment for this? Let's know.

Under which sections is the case registered

According to SP Abhishek Anand, action is also being taken against those who made the video viral. Bhanpura police have registered a case against Manohar Dhakad and another person on May 23. A case has been registered against Dhakad under sections 296 (public obscenity), 285 (endangering life and property), and 3(5) (mass crime) of the Indian Penal Code (BNS).

Advocate Jitin Rathore said that Section 296 of the CrPC is imposed when a person is seen doing obscenity in a public place. He said that even though this section is imposed, there are no very stringent provisions in this section in terms of crime. The first thing is that the charge should be proven in the case. If the charge is proved, then the punishment for this crime can be up to three months in jail or a fine of Rs 1000, or both.

He said that Section 296 of the BNS is a bailable and cognizable offence. Under this, if a person is found doing any such wrong act in a public place, then the police can immediately arrest him based on a complaint. But due to Section 296 being bailable, the accused gets bail very easily.

What is the provision of punishment in other sections?

Section 285 (endangering life and property) 3(5) (compound crime) has been imposed. Advocate Himanshu Rai explains that the meaning of this section is that a person endangers his own life and property. That is, he parked his vehicle on the road. This section is included in the category of collective crime because a woman is also seen in this scene, so this section has been included. According to Section 285 of the Indian Penal Code, whoever acts with such rashness or negligence that human life is endangered or due to which injury or damage to any other person is likely to be caused. If such charges are proved, the person can be imprisoned for six months or it can be extended. Or a financial penalty of up to one thousand rupees, or both, will be imposed.

Bail can be granted

He told that the type of sections that have been imposed in this case. This is a bailable, cognizable offence and can be tried by any magistrate. That is, according to the two sections imposed on the accused, he can get bail immediately.
