Rally Speech Lands Rahul Gandhi in Trouble: Summons Issued in Lucknow Court for Alleged Hate Speech

Lucknow's Additional Chief Judicial Magistrate-III has summoned Congress leader Rahul Gandhi over his alleged inflammatory remarks against Veer Savarkar for January 10, 2025. Evidence in prima facie of his statement under IPC sections, 153(A) and 505 that promotes enmity between groups and statements conducive to public mischief, has been found by the court.

Information about the complaint

The complaint, filed by advocate Nripendra Pandey, claims that Rahul Gandhi gave controversial statements at a press conference in Akola, Maharashtra on December 17, 2022. Gandhi allegedly described Savarkar as a "servant of the British" and a "pensioner," stating that Savarkar assisted the British while betraying Mahatma Gandhi and other leaders.

Allegations of Intent to Spread Hatred

Pandey charged Gandhi of deliberately uttering such a speech which created a disturbance and, according to him, that the pamphlets distributed in the press conference were also prepared earlier. Thus, an act was committed, said the opposition.

Orders Issued Earlier

Additional Chief Judicial Magistrate Ambrish Kumar Srivastava had directed the investigation under Section 156(3) of CRPC. The Hazratganj police had been instructed to probe into the case with an officer at the level of inspector supervising it.
