What Are the Laws for Running Coaching Institutes in India?

New Delhi: On January 18, 4, the central government of India issued new rules and regulations for coaching centers. These new rules bring significant changes for students and the coaching industry. For example, under the new regulations, probationary coaching institutes in any Indian state will not be allowed to admit children under 16 years of age.
The "Guidelines for Registration and Regulation of Coaching Centers 2024" aim to create a framework for the regulation and registration of coaching centers, suggest minimum standard requirements for operating coaching centers in India, and protect the interests of enrolled students. These regulations emphasize the importance of co-curricular activities that contribute to the overall development of children and provide psychological counseling and career guidance for students' mental well-being.
Key Guidelines for Coaching Centers

Registration and Compliance Coaching centers must submit an application for registration to the official body in the local jurisdiction. They need to comply with the government-mandated document requirements. If a coaching center has multiple branches, each branch is considered a separate entity and requires a separate registration application.

Age Restrictions Students under the age of 16 are not allowed to enroll in these coaching centers. Admission is permitted only after students pass their secondary school examinations.

Infrastructure Requirements Coaching centers must provide at least one square meter of space per student in each classroom. Compliance with fire safety codes is mandatory. Each coaching center must have fire and building safety certificates. Proper lighting, electrification, and ventilation arrangements must be maintained. Adequate CCTV cameras, medical assistance, and first aid kits are also essential requirements.

Fair Tuition Fees Tuition fees for courses must be reasonable and fair. Detailed receipts for the fees must be provided. A prospectus with authentic information about courses, their duration, classes, hostel facilities, exit policies, fee refund procedures, and more should be displayed.

Exit Policy and Fee Regulation If a student wishes to exit a course midway, the coaching center is required to provide a pro-rata refund within 10 days. No fee increase is permitted during the course duration, applicable to both hostel and course-related fees.

Grievance Redressal System A robust grievance redressal system must be established for students and parents. Employees, parents, and students can lodge complaints against coaching centers with the competent authorities, who will resolve the grievances within 30 days.

Penalties for Violations Coaching centers that violate the general requirements or any terms and conditions of registration will be fined. The first violation will incur a fine of ₹25,000, while the second offense may result in a fine of up to ₹1 lakh. Subsequent violations could lead to the cancellation of registration.

Transparency and Authenticity Coaching centers are instructed to stop making misleading promises and guarantees related to marks and ranks to attract more admissions. The new rules demand transparency. Coaching centers must maintain an updated website with the latest information about their tutors, their academic qualifications, the courses offered, detailed course descriptions, hostel facilities, and more.
These new regulations aim to ensure that coaching centers operate ethically, safely, and effectively, maintaining the trust of students and parents and ensuring their safety and education.
