Leader Kajal Nishad SP Alleges ₹7 million scam in Mumbai flat sale: A real estate horror tale
Gorakhpur: Samajwadi Party (SP) leader and a Bollywood actress Kajal Nishad has approached the Goregaon police of Mumbai for a complaint of being cheated by three persons of a multi-year property deal. Three persons, she said were builders and owner of a construction company, made her a victim of deceit after which she had brought a flat in 2015 worth ₹7 million. She alleges that the duo builders failed to hand over her possession even as the owner company failed to deliver the project.
In the year 2015, She booked a flat along with her husband, Sanjay Nishad from Synergy Construction Company in Goregaon area, Mumbai. The deal was made with Sarita Mantri and Shanti Narayan Rathi, while Sarita's husband, Sunil Mantri, was claimed to own this property. Payments were done in installments, and the registry for this flat was done. However, before they could actually take possession, the Nishads came to discover that the ownership of the property was under dispute, and hence court notices pasted on the premises.
Years of Delays and a Broken Agreement
According to Sanjay Nishad, they had asked for a refund once they came to know about the ownership problem. Years of adjournments led to the settlement in 2021 when the flat was valued at ₹8.5 million. The Nishads agreed to this and got the first partial payment of ₹4.65 million, and another ₹1.5 million later. But due to Kajal Nishad's other commitments in the 2022 elections where she ran as an SP candidate from Campierganj in Gorakhpur, further follow-ups were delayed.
Accused deny allegations, term it defamation
When the court resumed hearing on the case, Nishads claims that the accused parties stopped receiving phone calls. They registered the case formally at Goregaon Dindoshi police station. The respondents later replied during the pendency of this investigation denying it. Accused Sunil Mantri said that he had no connection to the disputed property and reported that he would file a defamation case against Kajal Nishad. Synergy Construction owner, Shanti Narayan Rathi, stated that the liquidator appointed by the court took back the flat due to some disputes and claimed that he promised the refund to Nishad also.
Political Background of Kajal Nishad
Kajal Nishad is a political activist and a candidate in the 2022 Assembly elections and 2024 Lok Sabha elections representing SP from Gorakhpur. As reported, political engagements have also delayed her follow-up on the matter which makes the case more intricate.
Legal Proceedings and Further Action
With the police now investigating the case based on the complaint, both parties now wait for legal proceedings to determine the end. A case that raises several issues pending in real estate transactions, puts emphasis on owner documents to be very clear, and ensures speedy legal recourse in property disputes. With the issue escalating, the allegations brought forth by Nishad along with the accused's reply attracts public attention and intensifies the issue further.
