Justice Shekhar Kumar Yadav Impeachment: MPs Demand Inquiry Over Hate Speech

On December 13, 2024, a motion was submitted in the Rajya Sabha calling for the impeachment of Justice Shekhar Kumar Yadav, a sitting judge of the Allahabad High Court. The motion, signed by 55 Rajya Sabha members, seeks the formation of an inquiry committee to investigate serious allegations against Justice Yadav, including hate speech, incitement to communal disharmony, and violations of judicial ethics. The MPs have requested that the motion be forwarded to the President for further action.

Grounds for Justice Shekhar Kumar Yadav Impeachment

The impeachment motion puts forward several charges against Justice Yadav, primarily related to his controversial remarks made during a lecture at an event organized by the Vishwa Hindu Parishad (VHP). The motion claims that Justice Yadav’s statements targeted religious minorities, incited communal disharmony, and violated the constitutional principles of equality and justice. His comments, which included comparisons between religious communities and their values, have been widely criticized for fostering intolerance and discrimination.

The MPs argue that such behavior is inconsistent with the responsibilities and ethical standards expected of a judge. They further state that his participation in a public debate on political matters, such as the Uniform Civil Code, is a breach of judicial conduct.

The Impeachment Process and Its Legal Implications

The process of impeachment is a rare and serious constitutional procedure in India. To initiate the process, a motion must be signed by at least 50 Rajya Sabha MPs. If the motion is admitted, an inquiry committee will be constituted to investigate the allegations. Although no judge in independent India has been successfully removed through impeachment, several attempts have been made in the past, making this motion a significant legal development.

The MPs’ motion underscores the importance of judicial accountability and the need for impartiality and respect for the Constitution. The outcome of this case could have far-reaching implications for the independence and integrity of the Indian judiciary.
