GURUGRAM, India -- Home buyers here are left stunned by the move of Smart World Gems, the real estate developer, which has cancelled the booked units of its consumers unilaterally. The contrary action has led to severe protests outside the corporate office of the developer in Sector 66 with the affected buyers terming Smart World Gems' actions "unethical".

The residential project in Sector 89 was launched in September 2021. The protestors claim that the cancellations began in September 2024 and carried on until October. Homebuyers have alleged that the builder cancelled their bookings without communication or reason and is currently selling the same units at a higher price to some other buyers.

Buyers Seek Refund and Regulatory Action

The protesters have been requesting that their previous bookings be reinstated according to the terms they had agreed upon at first. Several buyers have approached the Haryana Real Estate Regulatory Authority and the National Consumer Disputes Redressal Commission to file a complaint against the developers, demanding quick action. They also seek local administration's swift response.

Cases of Exploitation of Consumers

One complained, "I booked the unit under the 10:90 or 40:60 payment plan, but would only be asked by the developer through WhatsApp and phone calls. He would not agree upon formalizing it despite my insistence.".

In one emotional account, the buyer said that his mother had spent her pension funds to buy the unit whereas now the developer has canceled the booking illegally. He further made it clear that the developer is clearly violating the set laws through police, HRERA, and other regulatory authorities.

Gurugram Real Estate Sector Experiences an Escalating Dispute

The issue, in general, brings to the fore long-standing issues about the real estate of Gurugram and an ever-rising concern from the buyers who fear these developers will cheat on their financial investment. As protests continue and complaints accumulate, the pressure mounts on the authorities to enforce stricter regulations in the industry as well as to protect the rights of consumers.

What is more important, though, the case has raised questions about transparency, accountability, and consumer protection in the rapidly growing Indian real estate market.
